Terms of Service

1. Acceptance of Terms

By accessing or using HazirA+ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Description of Service

HazirA+ provides cloud-based HR and attendance management software including employee management, biometric attendance tracking, leave management, payroll processing, and related features ("Service").

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Take responsibility for all activities under your account

We reserve the right to suspend accounts that violate these Terms or applicable laws.

4. Subscription and Payment

The Service is available on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees as described in our pricing page
• Provide valid payment information
• Authorize recurring billing for your subscription period

All fees are in Bangladeshi Taka (BDT) and are non-refundable except as expressly provided. We may change pricing with 30 days' advance notice.

5. Free Trial

We may offer a free trial period. At the end of the trial, your account will require a paid subscription to continue. We reserve the right to modify or terminate trial offers at any time.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or in violation of any regulations
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse-engineer, decompile, or disassemble the Service
• Resell or sublicense the Service without written permission
• Use the Service to harass, discriminate against or harm any person
• Violate Bangladeshi labour laws or data protection regulations

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms. You are the data controller for your employee data. You warrant that you have lawful authority to collect and process such data and that employees have been informed as required by applicable law.

8. Intellectual Property

The Service, including all software, designs, logos and content, is owned by EzSoft and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes only.

9. Service Availability

We aim for 99.5% monthly uptime. Scheduled maintenance will be communicated in advance. We are not liable for service interruptions caused by factors outside our reasonable control (internet outages, natural disasters, etc.).

10. Limitation of Liability

To the maximum extent permitted by law, EzSoft shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Termination

Either party may terminate the agreement on 30 days' written notice. We may terminate immediately for material breach, non-payment, or conduct that endangers the platform. Upon termination, your data will be available for 90 days before permanent deletion.

12. Governing Law

These Terms are governed by the laws of Bangladesh. Any disputes shall be resolved in the courts of Dhaka, Bangladesh.

13. Changes to Terms

We may update these Terms. We will notify you via email or in-platform notice at least 14 days before material changes take effect. Continued use constitutes acceptance.
